Not all unemployed workers qualify for unemployment benefits and some that do end up losing their benefits. Often this is because they don’t understand what requirements workers must meet to continue receiving benefits. This article will look at the eligibility criteria for unemployment insurance in Tennessee and help you qualify for (and maintain) the benefits you are entitled to.
- TN UI REQUIREMENTS
1) You must be completely or partially unemployed. If you claim for benefits while you are working full-time, your benefits will be taken away and you will have to repay them. Tennessee allows for workers whose work hours are reduced due to lack of work to claim for unemployment benefits to supplement their wages. However, you must declare what your income is. Failure to declare part-time earnings will also get your claim cancelled.
2) You must be fit and able to work. Unemployment insurance is only offered to people who are willing and able to work immediately. If you are sick, on vacation or otherwise unable or unwilling to work you do not qualify for UI benefits. There are special arrangements for unemployed workers who are sick or become disabled while receiving unemployment benefits.
3) You must file for your weekly benefits. Once your initial claim is approved you must file weekly for your benefits. If you don’t, your claim could be cancelled.
4) You must actively search for work. The L&W Development can request proof of your work search. If you do not register for work or accept suitable work, your claim could be closed. However, if you are enrolled in an approved training program or you have a set date to return to work this requirement may be waived.
5) You must meet the financial requirements determined by Tennessee unemployment insurance guidelines. This includes earning a minimum income during your base period or working a minimum number of weeks for a registered employer before applying for UI benefits.
6) You must declare any wages you receive while receiving unemployment insurance benefits. You must declare these payments the week you work for them, not the week you receive them.
WAITING WEEK
Federal law requires sates to hold the first week of unemployment benefits. This week’s payment is not given to unemployed workers who must wait to the second week they file to start receiving payments. However, the Tennessee unemployment agency allows this “waiting week” to be paid to unemployed workers after they file for four weeks of unemployment benefits.
If you don’t meet these requirements your unemployment benefits could be terminated. This would also affect your eligibility for Emergency Unemployment Compensation and Extended Benefits.
